O R D E R
The petitioner herein is aggrieved against his non-selection in the recruitment notification issued in the year 2012. Eight years have lapsed since the recruitment took place and the selected candidates have all completed their training and are occupying the posts. At this stage, it would not be proper to consider the petitioner's candidature in a selection process that took place in the year 2012.
2. Learned counsel for the petitioner would submit that he has been all along filing writ petitions challenging his non-selection. In the orders passed by this Court, there was no positive direction for appointment of the petitioner but rather there was a direction to the respondents to consider the petitioner's candidature in the light of the decision of the Hon'ble Supreme Court in Avatar Singh vs Union of India reported in (2016) 8 SCC 171. The respondents have also considered his candidature and rejected the same through the impugned order.
3. Nevertheless, this Court is not inclined to interfere in the impugned order since much water has flown pursuant to the selection process and any further consideration would disturb the entire selection process. Accordingly, the writ petition stands dismissed. However, this order of dismissal shall not stand in the way of the petitioner raising the grounds raised in the present writ petition for the future selection process. No costs.
