ORDER : The Court Made the following order :- The petitioners, who are arrayed as accused Nos.1 to 4, in Crime No.644 of 2015 on the file of the respondent police, apprehend arrest at the hands of the respondent police for the alleged offences punishable under Sections 294(b), 323, 448 and 506(i) IPC and hence, seek anticipatory bail.
2. The case of the prosecution is that on 16.09.2015, the petitioners trespassed into the property of the defacto complainant and break open the lock and key and abused the defacto complainant in a filthy language and have beaten the defacto complainant.
3. The case of the petitioners is that the petitioners are innocent and they have been falsely implicated in this case. There is a civil dispute pending in A.S.NO.17 of 2014 between the petitioners and the defacto complainant before this Court and hence, the defacto complainant has lodged a false complaint against the petitioners.
4. The learned Government Advocate (Crl.Side) submitted that there is a civil dispute between the petitioners and the defacto complainant is pending and the petitioners trespassed into the property of the defacto complainant and abused the defacto complainant in filthy language. 5.Considering the facts and circumstances of the case, this Court is inclined to grant anticipatory bail to the petitioners, with certain conditions. Accordingly, the petitioners are ordered to be released on bail in the event of arrest or on their appearance before the learned Judicial Magistrate, Karaikudi, Sivagangai District and on each of them https://hcservices.ecourts.gov.in/hcservices/
executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the learned Magistrate concerned and on further condition that the second petitioner shall appear before the respondent police as and when required for interrogation and the petitioners 1, 3 and 4 shall appear before the respondent police daily at 10.00 a.m. until further orders. The petitioners shall comply with the condition stipulated under Section 438 Cr.P.C. scrupulously.
