ORDER : The Court made the following order :- The petitioner/sole accused , who was arrested and remanded to judicial custody on 26.12.2022 for the offence punishable under Sections 5(l), 6 of Protection of Child from Sexual Offences Act, 2012 and 506(i) of IPC in Crime No. 16 of 2022 on the file of the respondent police, seeks bail.

2. The case of the prosecution is that the accused who is aged about 47 years who is married man had trespassed into the house of the victim and had committed penetrative sexual assault on the minor victim girl, hence the case.

3. This is the second application for bail and the earlier application was dismissed as withdrawn by this Court on 24.01.2023 and once again this application was argued and when this court was about to dismiss the petition on merits, the learned counsel https://www.mhc.tn.gov.in/judis 1/2

CRL OP(MD). No.2725 of 2023 appearing for the petitioner seeks permission of this Court to withdraw this petition and he has also made an endorsement to that effect.

4. Recording the same, the Criminal Original Petition stands dismissed as withdrawn.
