O R D E R

This Writ Petition is filed seeking a direction to the respondents to cancel the legal heir certificate issued by the 3rd respondent in Certificate No.TN-720231230233 dated 20.01.2024 within a stipulated time that may be fixed by this Honourable Court.

The learned counsel appearing for the petitioner would submit that the petitioner has made a representation on 01.02.2024, seeking to cancel the legal heir certificate issued by the third respondent dated 20.01.2024 to the fourth respondent. Since the same was not considered, the petitioner has field this Writ Petition.

3. The learned Additional Government Pleader appearing for the respondents 1 to 3 would submit that with regard to the cancellation of legal heir certificate, an appeal remedy is available before the Revenue Divisional Officer. Without availing the same, the petitioner has filed this Writ Petition. Hence, he prays for dismissal of this Writ Petition. 2/4

4. The learned counsel appearing for the petitioner would submit that liberty may be granted to the petitioner to file an appeal before the concerned Revenue Divisional Officer.

5. This Court heard the submissions made by both sides and perused the materials available on record.

6. As rightly contended by the learned Additional Government Pleader appearing for respondents 1 to 3, the proper course available to the petitioner to seek cancellation of the legal heir certificate is to file an appeal before the Revenue Divisional Officer. Without availing such appellate remedy, the petitioner has filed the present writ petition. Therefore, this writ petition is liable to be dismissed.

7. Accordingly, this Writ Petition is dismissed with liberty to the petitioner to file an appeal before the concerned Revenue Divisional Officer. There shall be no order as to costs. 30.01.2026 vsm Index: Yes/No NCC: Yes/No 3/4
