This Criminal Original Petition has been filed by the petitioner to direct the second respondent herein to provide police protection to the petitioner's life, limb on the basis of the representation dated 01.02.2025.
2. According to the petitioner, she is working in Income Tax Department. The petitioner was married one Thiyagarajan and she gave birth of one male child and one female child. Due to misunderstanding, the petitioner and her husband were separated. A decree of divorce was also granted. The petitioner is the owner of the property in S.F.No.450/1, 451/1 situated at Courtallam, Tenkasi District. She was also constructed a building in the ground floor. One Neel Rajarathinam often visits the petitioner's house and he borrowed a sum of Rs.5,00,000/- from the petitioner. The petitioner belongs to Scheduled Caste and the said Neel Rajarathinam belongs to Christian Maravar Caste. Later, the Neel Rajarathinam came to know about the petitioner's caste and started to abuse her in filthy language by using her caste name. Therefore, the petitioner lodged a complaint as against the said Neel Rajarathinam before the 2/6
Courtallam Police Station and FIR was registered in Crime No.28/2025 for the offences punishable under section 296(b), 351(3) of BNS Act & 3(1)(r), 3(1)(s) of SC / ST Act. Thereafter, he was arrested and remanded to judicial custody from 18.01.2025. Thereafter, the third respondent herein who is the wife of the said Neel Rajarathinam and her supporters entered into the house of the petitioner and attacked her with stone and damaged her house windows and the third respondent abducted the petitioner in a car bearing registration number TN 76 AR 8299 from her home. Immediately, the petitioner approached the Courtallam police station for lodging complaint. Instead of filing a case, the third respondent threatened the petitioner and compelled to leave her property.
Because of the life threat, the petitioner lodged a complaint as against the 3rd respondent and her supporters on 20.01.2025. The respondent police issued receipt in SPGP.No.157 of 2025. The respondent police have not taken any action as against the respondents 3 to 5 herein. Hence, she filed the present criminal original petition.
3. The learned Government Advocate appearing for the respondent Nos.1 and 2 would submit that already they received a complaint on 01.02.2025 and issued CSR.No.104 of 2025 and the same is under enquiry. 3/6
The respondent police have also assured that they will complete the enquiry within a week, since, the representation of the petitioner is under enquiry by the second respondent.
4. Considering the submissions made by both side counsels, the Court directs the second respondent to consider the representation of the petitioner dated 01.02.2025 and dispose the same in accordance with law within a period of one week from the date of this order.
5. With the above said observations and directions, this Criminal Original Petition is disposed of.
