ORDER : The Court Made the following order :- The petitioner apprehending arrest at the hands of the respondent police for the offence punishable under Sections 406, 420 and 294(b) of I.P.C., in Crime No.120 of 2018, on the file of the respondent police, seeks anticipatory bail.

2. The learned counsel for the petitioner submitted that the petitioner is an innocent person and that he has not committed any such offence alleged by the respondent and prays for anticipatory bail in favour of the petitioner.

3. One Annakodi who is the defacto complainant had lodged a complaint against the petitioner and his relatives and his family members for cheating a sum of Rs.3,75,000/- by holding a false assurance that they would secure a public employment for her son. The learned counsel for the petitioner filed typed set of papers which indicates that there was a money transaction between the petitioner's brother Jeyakumar and the defacto complainant and the matter was enquired into and closed in the month of March 2018.

4. This Court prima facie on merits went through the contents of the learned counsel for the petitioner.

5. Considering the facts and circumstances of this case, this Court is inclined to grant anticipatory bail to the petitioner with certain conditions. Accordingly, the petitioner is ordered to be https://hcservices.ecourts.gov.in/hcservices/

released on bail in the event of arrest or on his appearance before the learned Judicial Magistrate No.II, Usilampatty, and executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the learned Magistrate concerned and on further condition that the petitioner shall appear before the respondent police as and when required for interrogation. The petitioner shall comply with the conditions stipulated under Section 438 Cr.P.C. Scrupulously.

6. The petitioner shall appear before the concerned Magistrate within a period of 15 days from the date on which the order copy made ready, failing which, the petition for anticipatory bail shall stand dismissed.
