Prayer in Crl.A(MD)No.224 of 2021:- This Criminal Appeal is filed under Section 14A(2) of the Scheduled Castes and the Scheduled Tribes (Prevention of Atrocities) Act 2015, to call for the records pertaining to the order, dated 28.04.2021 made in Crl.MP.No.467 of 2021 on the file of the Sessions Judge, Special Court for exclusively trial of cases under SC/ST (POA) Act, Dindigul and set aside the same and enlarge the appellant on bail in connection with Crime No.441 of 2020 on the file of the 2nd respondent by allowing this Criminal Appeal.
ORDER:- This Criminal Miscellaneous coming on for orders on this day and upon perusing the petition and the affidavit filed in support thereof and upon hearing the arguments of Mr.D.Venkatesh, Advocate for the Petitioner and of Mr.R.M.Anbunithi, Government 1/3
Advocate for the 1st & 2nd respondents, this Court made the following order:- This petition has been filed to relax the condition imposed on the petitioner in Crl.A(MD)No.224 of 2021, dated 24.06.2021.
2. The learned counsel appearing for the petitioner would submit that the petitioner is complying with the condition regularly. He further stated that the petitioner is working in Erode, hence he is unable to comply with the said condition.
3. The learned Additional Public Prosecutor appearing for the respondent would submit that the petitioner is regularly complying with the condition.
4. In the light of the above submission, the condition imposed on the petitioner in Crl.A(MD)No.224 of 2021, dated 24.06.2021 is modified to the effect that the petitioner shall appear before the trial Court once in a month i.e., on the first working day of every English calender month at 10.30 a.m., until further orders.
5. Accordingly, this petition is ordered.
