PRAYER: Writ Petition is filed under Article 226 of the Constitution of India, to issue a Writ of Certiorarified Mandamus, to quash the online rejection order passed by the 1st respondent dated 02.12.2025, the same and consequently direct the 1st respondent to issue a Legal Heir Certificate in respect of the petitioner deceased father.

ORDER

The present writ petition has been filed seeking to quash the order passed by the first respondent herein wherein the request of the petitioner for issuance of legal heir certificate has been rejected on the ground that the deceased Kanthasamy had two wives.

According to the learned Counsel appearing for the writ petitioner, the application seeking legal heir certificate was filed jointly by the legal heirs of the first wife as well as the second wife. In such circumstances, the first respondent cannot have any legal impediment for considering such application when there is consensus among the parties.

3. In view of the above said facts, the order impugned in the writ petition is hereby set aside and the matter is remitted back to the file of the first respondent herein. The first respondent is directed to issue notice to all the legal heirs of the deceased Kanthasamy through the first wife as well as through the second wife. In case if there is any consensus between the parties, a legal heir certificate shall be issued to them. The said exercise shall be completed within a period of ten weeks from the date of receipt of a copy of this order. 2/4

4. With the above said observations, this writ petition stands allowed. No costs.
