PRAYER: Writ Petition is filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus directing the 2nd Respondent to conclude the enquiry called for vide his proceedings in Na.ka.No.7860/2021/Aa4 dated 31.12.2021 on the representation dated 08.11.2021 preferred by the Petitioner for cancellation of the legal heir certificate dated 31.10.2018 issued in favour of the 3rd and 4th respondent and pass orders thereupon within the period that may be stipulated by this Court.

ORDER

The present writ petition has been filed seeking a direction as against the second respondent for expeditious disposal of the appeal preferred by the writ petitioner challenging the legal heir certificate issued by the Tahsildar, Dindigul East, on 31.10.2018 for the death of one Karuthi Gounder.

2. According to the learned Counsel appearing for the writ petitioner, he had preferred an appeal before the first respondent on 08.11.2021 and enquiry notice was also issued to appear on 28.01.2022. So far it has not been disposed of. Hence, the present writ petition.

3. Considering the above said facts, the second respondent is directed to consider the appeal on its merits and pass orders after giving due opportunity to all the interested parties and pass orders within a period of 8(eight) weeks from the date of receipt of a copy of this order.

4. With the above said observations, this writ petition stands disposed of. No costs.
