ORDER : The Court Made the following order :- The petitioner, who is arrayed as accused, apprehends arrest at the hands of the respondent police for the alleged offences punishable under Sections 379 IPC r/w 21(5) of Mines and Minerals Act, in Crime No.385 of 2015 on the file of the respondent police and hence, seeks anticipatory bail.

2.The case of the prosecution is that the petitioner and other lorry drivers had illegally stocked the river sand and on the complaint given by the defacto complainant, the case has been registered for the above said offences.

3.The case of the petitioner is that he is working as an in-charge in a Government approved Stockyard and the lorry drivers, who were caught for illegal sand mining, had stated in their confession that they would store the sand in the petitioner's sand yard and hence, this petitioner has been falsely implicated in this case.

4.The learned Government Advocate (Crl.side) submitted that with the help of this petitioner, the lorry drivers illegally stocked the river sand. He further submitted that the accused Nos. 2 to 11 were arrested and they are still in custody.

5.Considering the facts and circumstances of the case and also considering the gravity of the offence, I am not inclined to grant anticipatory bail to the petitioner.
