PRAYER:- For Bail in Crime No.129 of 2023 on the file of the respondent herein. ORDER:- The Court made the following order:- The petitioner is Accused No.3, who was arrested and remanded to judicial custody on 16.04.2023, for the offences punishable under Section 8(c) r/w 20(b)(ii)(c) of NDPS Act, in Crime No.129 of 2023, on the file of the respondent, seeks bail. 1/3

2. When the matter was taken up for hearing on 14.02.2025, learned Government Advocate would submit that eventhough witness have been examined, no cross examination has been made by the petitioner. On that account a report was called for from the learned I Additional Special Court for NDPS Act Cases, Madurai. A report has been submitted in D.No.144 dated 18.02.2025, mentioning that the case was posted for trial on 08.08.2024, Witnesses were present and examined. But the petitioner did not engage an advocate and sought appointment of legal aid counsel. Legal aid counsel was also appointed. The case was posted for examination of investigation officer. So it is seen without properly co-operating with the trial Court for completing the trial, he is repeatedly approaching this Court. So this petition will not lie.

3. Accordingly, this Criminal Original Petition is dismissed. However, there shall be a direction to the learned Principal Special Court for trial of Narcotic Drugs and Psychotropic Substances Act Cases, Madurai, to complete the trial process as ordered earlier.
