For Respondent : Mr.R.Srinivasan, Government Advocate (Crl.Side) PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :- For Anticipatory Bail in Crime No.15 of 2021 on the file of the Respondent Police.

ORDER : The Court made the following order :- The petitioner/2,4 and 6 who apprehend arrest at the hands of the respondent police for the offences punishable under Sections 306,309 r/w. 109,498(A) of IPC seek anticipatory bail.

2. The case of the prosecution is that the petitioners along with other accused said to have harassed the defacto complainant demanding more dowry, due to which she committed suicide. Hence the complaint.

3. The learned counsel for the petitioners would submit that the petitioners are innocent and a false case has been foisted against the petitioner. He would also submit that both the A2 and the deceased loved each other and they got married and due to some quarrel between them they tried to commit suicide in which the deceased died in the hospital and A2 is still under treatment. https://hcservices.ecourts.gov.in/hcservices/ 1/2

4. The learned Government Advocate(Crl.Side) would submit that investigation in this case is not yet completed and waiting for RDO report. He would also submit that the deceased in her dying declaration had mentioned the name of the petitioners as cause for her committing suicide. Hence he strongly objected to grant anticipatory bail to the petitioners.

5.Taking into consideration the nature and seriousness of the offences alleged against the petitioners and also taking note of the facts that the investigation is at the initial stage and RDO report is still awaited and upon the facts and circumstances of the case, this Court is not inclined to grant anticipatory bail to the petitioners.
