Writ Petition, filed under Article 226 of the Constitution of India, praying this court to issue a Writ of Certiorari, calling for the records culminating into the Notice dated 20.05.2022 in Na.Ka.No. 831/2020/E passed by the 2nd respondent based on the order dated 18.12.2020 in ROC.No. 35151/2018/C5 by the 1st Respondent u/s. 14 of the Securitisation and Reconstruction of Financial assets and enforcement of Security Interest Act (SARFAESI Act) and set aside the same as illegal.
ORDER:- This Petition coming on for hearing on this day and upon perusing the petition and the affidavit filed in support thereof and upon hearing the arguments of Mr.G.Vishnuram, Advocate for the Petitioner, this Court made the following order: https://www.mhc.tn.gov.in/judis
(Order of the Court was made by D.KRISHNAKUMAR,J) "There is no appearance on behalf of the respondents. The learned counsel for the Petitioner seeks extension of time for payment of the third instalment, as per order of this Court, dated 14.11.2022, made in the above Writ Petition. 2.The learned counsel for the Petitioner seeks further time of one month to pay the third instalment, ie., till 15.03.2023. But we are inclined to grant a further period of two weeks for payment of the third instalment. Accordingly, the Petitioner is granted two weeks time i.e.,till 01.03.2023, for payment of the third instalment, as per the order made in the above Writ Petition. 3.Accordingly, this Miscellaneous Petition is ordered. Post the matter on 02.03.2023, for compliance. No further time will be granted."
