ORDER : The Court Made the following order :- The petitioners, who are arrayed as A3 and A4 and they were arrested and remanded to judicial custody on 25.11.2014 for the alleged offence punishable under sections 8(c) r/w 20(b)(ii)(c) of NDPS Act, in Crime No.466 of 2014, on the file of the respondent police and hence, seek bail.

2.The case of the prosecution is that the accused were found in possession of 4 kgs of Ganja.

3.The learned counsel for the petitioners submitted that the petitioners are innocent persons and they have not committed any offence as alleged by the prosecution. He further submitted that based on the confession of the co-accused, the petitioners have been implicated in this case and the petitioners are in jail from 25.11.2014 and therefore, prayed that the bail petition has to be allowed. 4.The learned Government Advocate (Criminal side) appearing for the respondent submitted that the investigation is almost completed and no previous case is pending against the petitioners. 5.

Considering the fact and circumstances of the case and also considering the fact that the investigation is almost completed and no previous case is pending against the petitioners, this court is inclined to enlarge the petitioners on bail with certain conditions. 6.Accordingly, the petitioners are ordered to be released on bail, on their executing a bond for a sum of Rs.50,000/- (Rupees Fifty thousand only) with two sureties each for a like sum to the satisfaction of the learned Principal Special Court for NDPS Act Cases, Madurai and on further condition that the petitioners shall report before the respondent police daily at 10.30 a.m. and 05.00 p.m. until further orders. sd/- 16/12/2014 / TRUE COPY / https://hcservices.ecourts.gov.in/hcservices/ Sub-Assistant Registrar (C.S.)
