proposed construction of the 70 feet long new bus stop in the vacant space ahead of petitioner's property's frontage in S.Nos.79/G2 and 79/3D2 situated at Pichandavar Koil Village, Manachanallur Taluk, Trichy District to some other place.

ORDER

This Writ Petition has been filed to direct the respondents to relocate the proposed construction of the 70 feet long new bus stop in the vacant space ahead of petitioner's property in S.Nos.79/G2 and 79/3D2 situated at Pichandavar Koil Village, Manachanallur Taluk, Trichy District to some other place.

2. The learned Additional Government Pleader appearing for the respondents would submit that for the purpose of public usage and convenience, the subject bus stop has been constructed and it is now in usable condition.

3. The learned counsel appearing for the petitioner would submit that since the subject bus stop has been constructed in front of the petitioner's 2/5

property, there is no sufficient space available for the petitioner and the petitioner's movement from his property is restricted.

4. I have given due consideration to the submissions made on either sides.

5. In the present case, if at all the petitioner's movement is restricted and he is not able to come out of his property due to the construction of the subject bus stop and he requires a pathway, he is at liberty to make a representation to the appropriate authorities.

6. At this juncture, the learned Additional Government Pleader appearing for the respondents would submit that the authorities have provided 15 feet pathway for the petitioner's movement into his property.

7. Recording the above submission, this Writ Petition is disposed of. No costs.
