O R D E R

This Writ Petition has been filed seeking issuance of a Writ of Mandamus directing the first respondent to take on file the arbitration petition dated 15.12.2025 filed by the petitioner under Section 3G(5) of the National Highways Act, 1956, seeking enhanced compensation for the acquired land of the petitioner in S.Nos.104/5, 104/3, 104/6 and 104/7, situated at Paiyur Village, Pillaivayal Taluk, Sivagangai District and to pass orders granting enhanced compensation along with all other statutory benefits within such time as may be stipulated by this Court.

2. With the consent of the parties, this Writ Petition is taken up for final disposal at the admission stage itself. Page No. 2 of 6

3. The grievance of the petitioners is that the subject properties belonging to the petitioners were acquired by the Government for the purpose of laying a bypass road around Sivagangai Town in the year 2011.

4. The District Revenue Officer, vide proceedings dated 19.11.2025, in respect of the land belonging to the first petitioner measuring an extent of 740 sq. mts., determined the compensation at Rs.14,28,863/-, though the market value of the said land was Rs.91,43,440/-. the District Revenue Officer, vide proceedings dated 17.11.2025, in respect of the land belonging to the second petitioner measuring an extent of 663 sq. mts., determined the compensation at Rs.12,80,184/-, though the market value of the said land was Rs.81,92,028/-. The fair compensation ought to have been determined and paid to the petitioners.

5. Therefore, the petitioners submitted an arbitration petition dated 15.12.2025 under Section 3G(5) of the National Highways Act, 1956, seeking enhancement of compensation. Since the same has not been taken Page No. 3 of 6

on file, the petitioners have been constrained to file the present Writ Petition.

6. The learned Government Advocate appearing for the respondents, on instructions, would submit that the petitioners' arbitration appeal dated 15.12.2025 would be taken on file and appropriate orders would be passed by the first respondent within a period of eight weeks.

7. Recording the above submission and without expressing any opinion on the merits of the matter, this Writ Petition is disposed of with a direction to the first respondent to take on file the arbitration appeal of the petitioners dated 15.12.2025 and to pass appropriate orders on its merits and in accordance with law within a period of eight weeks from the date of receipt of a copy of this order. The first respondent is also directed to provide a reasonable opportunity of hearing to the petitioners before passing any order. There shall be no order as to costs.
