ORDER

The petitioner filed a complaint under Section 138 of the Negotiable Instrument Act r/w 200 of Cr.P.C before the Judicial Magistrate I, Dindigul. The said complaint was returned from time to time. Therefore, this criminal original petition has been filed for directing the Judicial Magistrate I, Dindigul to take a complaint on file.

2.Since an order is being passed without notice to the respondents and since the matter at the precognizance stage, I am consciously refraining from discussing the issue on merits. If I am going into merits of the matter, it may possibly prejudice the defence that may be available to the accused. Without any further discussion, I direct the Judicial Magistrate I, Dindigul to take the complaint bearing SR.No.800 of 2020 on file and deal with the matter in accordance with law.

3.With the above observations, the Criminal Original Petition stands allowed.
