Respondents PRAYER: This Criminal Original Petition has been filed under Section 482 of Criminal Procedure Code, to pass an order of direction to change the investigation to CBCID the 6th respondent herein or any other police officer and to file final report in respect of the case registered in FIR in Cr.No.217/2013 under section 454 and 380 IPC on 21.04.2013 for the recovery of the machinery and other things stolen from the shop of the petitioner and to take necessary action against the erred police official in the interest of justice. O R D E R
This Criminal Original Petition has been filed to pass an order of direction to change the investigation to CBCID the 6th respondent herein or any other police officer and to file final report in respect of the case registered in FIR in Cr.No.217/2013 https://hcservices.ecourts.gov.in/hcservices/
under section 454 and 380 IPC on 21.04.2013 for the recovery of the machinery and other things stolen from the shop of the petitioner and to take necessary action against the erred police official in the interest of justice.
2.When the matter was posted for admission on 22.12.2014, there is no representation for the petitioner and it was ordered to post after vacation. Thereafter, the matter is pending for the past 4 years without even ordering notice or admitting by this Court. 3.It seems that the petitioner has no interest to proceed with the matter, further. More over, the case is of the year 2014. Therefore, this Court is of the view that the pendency of this criminal original petition would not serve for any purpose. 4.In view of the above, the Criminal Original Petition is dismissed.
