ORDER : The Court Made the following order :- The petitioner, who is arrayed as sole accused, apprehends arrest at the hands of the respondent police for the alleged offences punishable under Sections 6(2)(3) of T.N.S.C.(RDGS) Order 1982 read with Section 7(1) (A)(ii) of E.C. Act, 1955, in Crime No.
410 of 2013 on the file of the respondent police and hence, seeks anticipatory bail. 2.The case of the prosecution is that the petitioner is a salesman at Naduvakurichi Ration Shop and on 20.06.2013, the defacto complainant inspected the ration shop and at that time he found that 42 liters kerosene was in excess and 489 pockets of Palm Oil was found missing worth about Rs.24,450/-. Therefore, the case has been registered for the above said offences.
3.The case of the petitioner is that the petitioner is an innocent person and he has not committed any offence as alleged by the prosecution and to prove his bonafide, he paid a sum of Rs.24,450/-. 4.Heard the learned Government Advocate (Crl.Side) appearing for the respondent.
5.Considering the facts and circumstances of the case and also considering the fact that the amount of Rs.24,450/- was paid by the petitioner, this Court is inclined to grant anticipatory bail to the petitioner, with certain conditions. Accordingly, the petitioner is ordered to be released on bail in the event of arrest or on his appearance before the learned Judicial Magistrate No.II, Tirunelveli and on each of them executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the learned https://hcservices.ecourts.gov.in/hcservices/
Magistrate concerned and on further condition that the petitioner shall appear before the respondent police daily at 10.00 a.m., for a period of two weeks and thereafter, as and when required. The petitioner shall comply with the condition stipulated under Section 438 Cr.P.C. scrupulously.
6.
