This Writ Petition is filed seeking a direction to forbear the 2nd respondent from taking any further action in O.A. No.5/2023 pending in its file, in lieu of its order, annexure to order including draft scheme dated 6.11.2025 made in O.A. No.5/2023 pending disposal of the appeal in A.P.No.1 of 2026 on the file of 1st respondent.

2. Mr.R.G.Shankar Ganesh, learned counsel, who takes notice for the respondents 4 to 6 would submit that in this Writ Petition 2/4

the petitioner has challenged the draft scheme dated 06.11.2025. However, the said draft scheme ultimately culminated in the form of a modified final scheme and the same was approved by the Joint Commissioner on 12.01.2026. Therefore, the prayer in the Writ Petition has become infructuous.

3. The learned counsel appearing for the petitioner seeks permission of this Court to withdraw this Writ Petition with liberty to challenge the modified final scheme dated 12.01.2026 and he has also made an endorsement to that effect.

4. In view of the above, this Writ Petition is dismissed as withdrawn, with liberty to the petitioner to challenge the modified final scheme dated 12.01.2026. There shall be no order as to costs.
