Criminal Original Petition filed under section 482 of Criminal Procedure Code, to direct the first respondent to withdraw the petitioner compliant dated 07.01.2020 pending before the Respondent No.2, and entrust the same to any other officer not below the rank of Deputy Superintendent of police for investigation of the complaint based on the petitioner's representation dated 19.01.2020 within the period stipulated by this Honourable Court. This Criminal Original petition has been filed to direct the first respondent to withdraw the petitioner compliant dated 07.01.2020 pending before the Respondent No.2, and entrust the same to any other officer not below the rank of Deputy Superintendent of police for investigation of the complaint based on the petitioner's representation dated 19.01.2020 within the period stipulated by this Honourable Court.
2. Today, when the matter is taken up for hearing, the learned Government Advocate(Crl.Side) would submit that the complaint of the petitioner was taken on file in C.No.03/DCB/MD/2020 dated 10.01.2020 for enquiry and she would submit that summons have https://hcservices.ecourts.gov.in/hcservices/ 1/2
Crl.O.P(MD).No.3120 of 2020 been issued to Rajapandi and his wife. She would also submit that enquiry will be done in accordance in law.
3. At this juncture, the learned counsel for the petitioner would submit that is would be suffice if a direction may be issued to the second respondent to complete the investigation at the earliest.
4. In view of the above, there shall be a direction to the second respondent to complete the enquiry in accordance with law within a period of four weeks from the date of receipt of a copy of this order.
5. With the above direction, the Criminal Original Petition is disposed of.
