namely K.Venishkumar, S/o.Karuppaiah, convict Prisoner C.P.No.6100 confined at Central Prison, Madurai for three days to assist with her for their children ear piercing function which is scheduled to be held on 06.02.2026 within the time stipulated by this Court.

O R D E R
[Order of the Court was made by G.K.ILANTHIRAIYAN, J.] The prayer in the petition is to quash the impugned order passed by the second respondent in No.325/Tha.Gu.2/2026 dated 29.01.2026 and direct the second respondent to provide emergency leave to the petitioner's husband namely K.Venishkumar, S/o.Karuppaiah, convict Prisoner C.P.No.6100 confined at Central Prison, Madurai for three days to assist with her for their children ear piercing function which is scheduled to be held on 06.02.2026 within the time stipulated by this Court.
2. It is the case of the petitioner that her husband was convicted by the Special Court for exclusive trial of cases under POCSO Act, Virudhunagar District at Srivilliputhur in Spl.S.C.No.7 of 2019 on 23.12.2021 for the offences
under Section POCSO Act, which was also confirmed by this Court in Crl.A(MD) No.363 of 2022. While being so, the petitioner being the wife of the convict has submitted representation seeking three days emergency to her husband for the ear piercing ceremony of their children, however the same was rejected on the ground that no arrangement has been made for the ear piercing ceremony which is scheduled on 06.02.2026. Further the convict is also facing trial in another case.
3.The learned counsel appearing for the petitioner would submit that the convict may be granted one day emergency leave to attend the function. 4.. Considering the fact and circumstances, this Court is inclined to grant one day emergency leave to the convict with single escort without any escort charges.
5. Accordingly, the impugned order passed by the second respondent is set aside and writ petition is disposed of with the following directions: (i) The respondents are directed to grant one day emergency leave with single escort to the convict prisoner namely, K.Venishkumar, S/o.Karuppaiah,
convict Prisoner C.P.No.6100 confined at Central Prison, Madurai on 06.02.2026. The convict prisoner shall be released from the prison on 06.02.2026 at 6.00a.m., (ii) He shall report back to the Superintendent of Prison, Central Jail, Madurai / third respondent , by 06.02.2026 at 5.00 pm.,., (iii) The petitioner shall produce all necessary documents, along with a copy of this order, before the jail authorities, (iv) During the leave period, the convict prisoner shall abide by all the conditions prescribed in the Jail Manual.
