ORDER : The Court Made the following order :- The petitioner in Crl.O.P.No.23027 of 2015, who is arrayed as accused No.1 in Crime No.54 of 2014 on the file of the respondent police, who was arrested on 12.10.2015 at the hands of the respondent police for the alleged offences punishable under Section 420 of IPC and hence, seeks bail. The petitioner in Crl.O.P.(MD) No. 23033 of 2015, who is arrayed as sole accused in Crime No.52 of 2014 on the file of the respondent police, who was arrested on 12.10.2015 at the hands of the respondent police for the alleged offences punishable under Sections 406 and 420 of IPC and hence, seeks bail.
2. The case of the prosecution is that the petitioner is the Regional Manager of Reliance communication and Reliance Petroleum and in order to supply Reliance generators and to establish Reliance call centre for Tamil language in Tuticorin District, he received Rs.30 lakhs from the defacto complainant in Crl.O.P.No.23027 of 2015 and he received Rs.10 lakhs from the defacto complainant in Crl.O.P.No.23033 of 2015. He neither supplied goods nor returned the amount and when the defacto complainant asked for refund of money, he threatened him with dire consequences.
3.The case of the petitioner is that he is an innocent person and he has not committed any offence, The Advocates namely, S.P.Warrior, Siluvai, Haridass and Baskaran approached the petitioner in his house and threatened him to settle the issue with the complainants to avoid https://hcservices.ecourts.gov.in/hcservices/
criminal case. The petitioner requested time to settle the matter and they refused to grant time and took articles, money, cars worth about Rs.1,50,00,000/- from the petitioner and assured him to settle the issue amicably. They did not settle the amount with the defacto complainants. The petitioner was arrested and while he was in judicial custody he gave a complaint to the Superintendent of Police, Tuticorin District to take necessary action against the Advocates and based on the same, a case has been registered in Crime No.1003 of 2015 for the offences under Sections 420, 380(NP), 506(ii) IPC.
4. The learned Government Advocate(Crl. Side) on instructions submitted that the petitioner is involved in two more previous cases and the petitioner cheated the amount from the people to the tune of Rs.2 crores and investigation is pending and if the petitioner is enlarged on bail, he will tamper evidence.
5. Considering the gravity of the offence, this Court is not inclined to grant bail to the petitioner. Hence, the petitions are dismissed.
