LENIN KUMAR, Advocate for the petitioner and of MR.C.MAYILVAHANA RAJENDRAN, Additional Public Prosecutor, on behalf of the Respondents the court made the following order:- This petition has been filed to relax the condition imposed on the petitioner in CRL MP(MD)No.1307 of 2016 in Crl.A.(MD) No.347 of 2015, dated 15.02.2016.

2. Heard Mr.T.Lenin Kumar, learned counsel for the petitioner and Mr.C.Mayilvahana Rajendran, learned Additional Public Prosecutor.

3. It is seen from the records that earlier, the petitioner was

granted bail with a condition to appear before the concerned Court once in 15 days. Thereafter, the condition was modified to appear before the concerned Court once in a month.

4.Considering the fact that the appeal is pending, and in order to ascertain the availability of the appellant, the above condition has been imposed and the condition also not onerous. In the above circumstances, the prayer cannot be granted and the petition is dismissed.
