BEFORE THE MADURAI BENCH OF MADRAS HIGH COURT Dated : 16.02.2018 CORAM :

THE HONOURABLE MR.JUSTICE G.R.SWAMINATHAN W.P(MD)No.1012 of 2018 Gorijan ... Petitioner Vs.

1.The Principal Secretary/Commissioner of Treasuries and Accounts, New Health Insurance Scheme 2014, Integrated Office Complex for Financial Department Nandanam, Chennai.

2.The District Treasury Officer, District Treasury Office, Collector Office, Madurai - 20.

... Respondents Prayer : Writ Petition is filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus, to direct the respondents to give medical reimbursement to the petitioner by considering representation dated 16.12.2017.

For Petitioner : Mr.R.Manoharan For Respondents : Mrs.S.Srimathy, Spl.G.P.

ORDER

The petitioner is a retired Corporation school teacher. She took treatment in a non network hospital. She claimed medical reimbursement thereafter. By the impugned order dated 31.10.2017, the second respondent informed the petitioner that since the petitioner took treatment in a non network hospital, it is not possible to accede to her request for medical reimbursement. 2.The said order cannot be said to be incorrect. It is very much within the norms laid down in G.O.Ms.No.171 dated 26.06.2014. The petitioner has however moved the first respondent by lodging a representation dated 16.12.2017. The petitioner wants this Court to direct the first respondent to pass orders on the said representation. As per clause 12 of G.O.Ms.No.171 dated 26.06.2014, an appeal against the decision of the second respondent would lie before the first respondent.

3.Therefore, this Court without expressing any opinion on the merits of the matter, directs the first respondent to dispose of the petitioner's representation in accordance with law, within a period https://hcservices.ecourts.gov.in/hcservices/

of 12 weeks from the date of receipt of a copy of this order. 4.This writ petition is disposed of with the above direction. No costs.
