Respondents Prayer : Writ Petition is filed under Article 226 of the Constitution of India, to issue a Writ of Certiorarified Mandamus, to call for the records pertaining to the impugned order passed by the 3rd respondent in O.Mu.No.163/3/2016/M1 dated 20.07.2016 and quash the same and consequently direct the respondents to give medical reimbursement to the petitioner incurred on behalf of his wife's treatment.

ORDER

The petitioner is a retired Deputy Inspector of Survey. His wife is afflicted with Spinal problem. She was therefore admitted in a hospital for treatment. Operation was performed and the petitioner's wife was discharged on 03.11.2015. The petitioner spent a sum of Rs.1,05,732/-. The petitioner applied to the third respondent for medical reimbursement. The third respondent, by the impugned order dated 20.07.2016, returned the petitioner's application on the ground that the petitioner's wife had taken treatment in a non network hospital. Questioning the same, this writ petition has been filed.

2.The impugned order cannot be said to be incorrect. It is very much within the norms laid down in G.O.Ms.No.171 dated 26.06.2014. However, the petitioner has the liberty to move the Principal Secretary/Commissioner of Treasuries and Accounts, New Health Insurance Scheme 2014, Integrated Office Complex for Financial Department, Nandanam, Chennai, by way of filing an appeal. The petitioner is permitted to lodge an appeal before the Committee headed by the said authority. As and when such a representation is lodged, the said Committee shall dispose of the same expeditiously.

3.This writ petition is disposed of with the above direction. No costs.
