(CRIME NO.76/2016) ..RESPONDENT/COMPLAINANT Petition praying that in the circumstances stated therein and in the petition filed therewith the High Court will be pleased to grant extension of time for a further period of one month for the appearance of the petitioner before the learned Judicial Magistrate concerned as per the order passed in Crl.O.P.(MD).No.4038/2016 order dated 23.3.2016. Order : This petition coming on for orders upon perusing the petition filed in support thereof and upon hearing the arguments of M/S.BABU RAJENDRAN, Advocate for the petitioner and of Mr.C.MAYIL VAHANA RAJENDRAN, Additional Public Prosecutor, for the Respondent, the court made the following order:- This application is filed to grant extension of time for the appearance of the petitioner before the learned Judicial Magistrate concerned, as per the order passed by this court in Crl.O.P(MD)No.4038 of 2016, dated 23.03.2016.

2.The learned counsel appearing for the petitioner has submitted that the petitioner was granted anticipatory bail by this court on 23.03.2016 with a condition to appear before the concerned Magistrate within a period of 15 days from the date of receipt of a copy of the order and that the order copy was made ready and delivered to the petitioner on 28.03.2016 and hence, the petitioner ought to have appeared before the learned Judicial Magistrate on or before 11.04.2016. In the above circumstances, the petitioner fell down in the bath room and sustained injuries on his hip on 04.04.2016 and the doctor advised him to take bed rest for a month and hence, the petitioner was not able to appear before the Magistrate concerned. petitioner.

3.The learned Government Advocate (Criminal side) has not disputed the said fact.

4.Keeping in view of the above facts, this court is inclined to grant time to the petitioner upto 26.04.2016 to execute the sureties before the court concerned.
