ORDER : The Court made the following order :- The petitioners, who were arrested and remanded to judicial custody on 27.11.2025 based on the NBW issued by the trial Court, for the offences punishable under Sections 8(c) r/w 20(b) (ii)(B) of NDPS Act, r/w Section 77 of Juvenile Justice (Care and Protection of Children) Act, 2015, in Crime No.141 of 2022 on the file of the respondent police, which was taken on file as C.C.No.243 of 2023, seek bail.

2. The learned counsel for the petitioners submitted that the petitioners were regularly appeared before the trial Court. During the trial proceedings, the petitioners were not able to attend the trial Court. Hence, the trial Court issued NBW against the petitioners and they were arrested in judicial custody from 27.11.2025. Hence, he seeks bail to the petitioners.

3. The learned Additional Public Prosecutor submitted that the petitioners have jumped out of bail during trial and thereafter they were secured through NBW on 27.11.2025. He further submitted that the contraband recovered from the petitioners is not commercial quantity. Hence, he opposed for grant of bail to the petitioners.

4. Taking into consideration of the facts and circumstances of the case and the petitioners are jumped out of bail and also considering the 3/7

period of incarceration suffered by the petitioners, this Court is inclined to grant bail to the petitioners, subject to the following conditions:

Accordingly, the petitioners are ordered to be released on bail on executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) each with two sureties, each for a like sum to the satisfaction of the learned Principal Sessions Judge for NDPS Act Cases, Madurai, and on further conditions that :- [a] the petitioners and the sureties shall affix their photographs and left thumb impression in the surety bond and the Magistrate may obtain a copy of their Aadhaar card or bank pass book to ensure their identity;

[b]the petitioners shall report before the trial Court daily at 10.30 a.m., and for all hearing dates without fail;

[c] the petitioners shall not tamper with the evidence or witness either during investigation or trial;

[d] the petitioners shall not abscond either during investigation or trial;

[e] On breach of any of the aforesaid conditions, the learned Magistrate/Trial Court is entitled to take appropriate action against the petitioners in accordance with law as if the conditions have been imposed and the petitioners is released on bail by the learned Magistrate/Trial Court himself as laid down by the Hon'ble 5/7

Supreme Court in P.K.Shaji vs. State of Kerala [(2005)AIR SCW 5560];

[f] If the accused thereafter absconds, a fresh FIR can be registered under Section 269 BNS.
