PRAYER : This Civil Revision Petition is filed under Section 227 of the Constitution of India, to direct the learned Sessions Judge, Mahila Court, Trichy to expeditiously hear the original suit in O.S.No.29 of 2009 on the file of the Sessions Judge, Tiruchirappalli.

This Civil Revision Petition has been filed to direct the learned Sessions Judge, Mahila Court, Tiruchirappalli, to expedite the proceedings in O.S.No.29 of 2009.

C.R.P(MD).No.771 of 2022 2.The learned counsel for the petitioners submitted that the first petitioner is a senior citizen aged about 82 years. He further submitted that the respondents filed I.A.No.13 of 2017 and I.A.No.1 of 2019 to drag on the proceedings in the suit, since they are not having a good case. The suit was filed in the year 2009 and it is still pending without any progress. Hence, she seeks expeditious disposal of the suit.

3.Considering the nature of relief to be granted, issuance notice to the respondents is dispensed with.

4.On a perusal of docket entries made in the suit, it is seen that I.A.No.13 of 2017 was filed for appointment of advocate commissioner and the same was allowed and advocate commissioner was also appointed but the said advocate commissioner has not filed his report and plan till date. It is seen that the suit was pending for more than 12 years. Hence, the learned Sessions Judge, Mahila Court, Tiruchirappalli, is directed to secure the advocate commissioner's report and plan and dispose of the suit as expeditiously as possible.

5.With the above direction, this Civil Revision Petition is allowed. No costs.
