PRAYER :- For Bail in Crime No.177 of 2022 on the file of the Respondent Police.

ORDER : The Court made the following order :- The petitioner/sole accused , who was arrested and remanded to judicial custody on 01.12.2022 for the offence punishable under Sections 5(l)5(n),5(j)(ii) and 6 of Protection of Child from Sexual Offences Act, 2012 in Crime No. 177 of 2022 on the file of the respondent police, seeks bail.

2. The learned Additional Public Prosecutor would submit that the case is pending trial in S.C. No.2 of 2023 on the file of the Mahila Court, Dindigul. He would further submit that the victim become pregnant and later it was aborted and the fragment has been sent for DNA analysis and as and when the DNA analysis report is received the trial Court will be able to complete the trial. https://www.mhc.tn.gov.in/judis 1/2

3. The learned counsel appearing for the petitioner would submit that the petitioner and the victim are close relatives and the petitioner is the maternal uncle of the victim. He would further submit that the petitioner is not pressing the application for bail and would pray that a direction may be issued to the trial Court to dispose the case as expeditiously as possible and he seeks permission of this Court to withdraw this petition and he has also made an endorsement to that effect.

4. Recording the same, the Criminal Original Petition stands dismissed as withdrawn with a direction to the trial Court to complete the trial as expeditiously as possible preferably within a period of three months from the date of receipt of DNA report. sd/- 10/02/2023 / TRUE COPY / /02/2023 Sub-Assistant Registrar (C.S.)
