Respondent/Complainant Prayer: This petition is filed under Sections 482 r/w 439(1)(b) of Cr.P.C., to modity the condition No.2 imposed in Crl.M.P.No.12 of 2022, dated 08.02.2022 passed by the Special Court for Exclusive Trial of Cases under SC/ST (POA) Act, Dindigul. ORDER

This petition has been filed seeking modification of the condition imposed by the Special Court for Exclusive Trial of Cases under SC/ST (POA) Act, Dindigul in Crl.M.P.No.12 of 2022, dated 08.02.2022, wherein, the learned Sessions Judge, directed the petitioner and other accused to appear before the said Court and signed daily at 10.00 a.m. on all working days until further orders. 2.The learned counsel for the petitioner would submit that the petitioner, in pursuance of the directions, has appeared and signed before the Court on 10.02.2022 and 11.02.2022 and thereafter, he was tested positive for Covid-19 and hence, he was not in a position to appear before that Court and that the other accused have been complying with the condition. He would further submit that the petitioner is ready to comply with the directions from tomorrow i.e. 23.02.2022 onwards.

3.Considering the above facts and circumstances and also the fact that the petitioner was tested positive for Covid-19, this Court is inclined to condone the absence for the period from 12.02.2022 till today and the petitioner is permitted to comply with the directions from tomorrow i.e. 23.02.2022 onwards. https://hcservices.ecourts.gov.in/hcservices/ 1/2
