PRAYER: Petition filed under Article 226 of the Constitution of India, to issue a writ of certiorarified mandamus calling for the entire records in connection with the impugned letter issued by the first respondent vide letter reference No.SCN/320118829/2024, dated 28.11.2024 and quash the same and consequently direct the first respondent to re-issue a fresh passport based on the application submitted by the petitioner vide file No:MD1077077209524, dated 30.10.2024.

By the impugned letter dated 28.11.2024, the first respondent refused to re-issue the petitioner's passport application through Application ID No.24-1013186631 and File No.MD1077077209524 on the ground that the petitioner was involved in Crime No.1340 of 2023, on the file of S.S.Colony Police Station, Madurai City, for the offence under Sections 143, 341, 290, 448 and 511 I.P.C., and also required the petitioner to submit his explanation, which is under challenge in this writ petition.

Today, when the matter is taken up for consideration, learned counsel appearing for the first respondent and the learned Government Advocate (Criminal Side) appearing for the respondents 2 to 4, on instructions, submitted that the case in Crime No.1340 of 2023, registered against the petitioner, was quashed by this Court by order dated 06.01.2025, passed in Crl.O.P.(MD) No.67 of 2025 and therefore, there is no criminal case pending against the petitioner as on date and the application submitted by the petitioner for re-issue of his passport can be considered.
3. In the light of the above, the impugned order dated 28.11.2024, passed by the first respondent, is hereby quashed and the matter is remanded back to the first respondent to re-consider the petitioner's Application ID No. 24-1013186631 and File No.MD1077077209524 afresh and to pass appropriate orders in accordance with law for re-issue of passport, within a period of two weeks from the date of receipt of a copy of this order.
4. Accordingly, this writ petition is disposed of. No costs. 10.02.2025 NCC :
