PRAYER :- For Bail in Crime No.192/2023 on the file of the Respondent Police.

ORDER : The Court made the following order :- The petitioner/sole accused, who was arrested and remanded to judicial custody on 31.01.2023 for the offences punishable under Sections 4(1)(a), 4(1-A), 4(1-i) of TNP Act in Crime No.192 of 2023 on the file of the respondent police, seeks bail.

2. The case of the prosecution is that on 31.01.2023 the petitioner was found in possession of 27 number of TASMAC brandy bottles and sale amount of Rs.1640/- hence the case.

3. The learned counsel appearing for the petitioner would submit that the petitioner is innocent and a false case has been foisted against him. He would further submit that the petitioner is in judicial custody from 31.01.2023, hence he seeks bail.

4. The learned Additional Public Prosecutor appearing for the respondent would submit that the the petitioner was found in https://www.mhc.tn.gov.in/judis 1/2

CRL OP(MD). No.2733 of 2023 possession of 27 number of TASMAC brandy bottles and sale amount of Rs.1640/-, hence he objected to grant bail to the petitioner. He would further submit that 13 previous cases are pending against the petitioner.

5. Heard. Perused the materials available on record including the First Information Report.

6. Taking into consideration of the facts and circumstances of the case and also the taking into consideration the previous bad antecedents of the petitioner, this Court is not inclined to grant bail to the petitioner.

7. Hence the Criminal Original Petition stands dismissed for the present.
