PRAYER: Criminal Original Petition filed under Section 482 Cr.P.C. praying to direct the learned Judicial Magistrate, Fast Track No.I, Nagercoil to expedite the trial in C.C.No.47 of 2016 and dispose the same in the speedy manner within a time frame as fixed by this Honourable Court.

ORDER

This petition has been filed seeking direction to direct the learned Judicial Magistrate, Fast Track No.I, Nagercoil to expedite the trial in C.C.No.47 of 2016 and dispose the same in the speedy manner within a time frame as fixed by this Honourable Court.

2. The learned counsel for the petitioner would submit that the petitioner is the accused facing trial in C.C.No.47 of 2016 for the offence under Section 138 and 142(b) of Negotiable Instrument Act. He would submit that originally the case was filed during the year 2013 and was taken on file by the learned Judicial Magistrate, Fast Track No.I, Nagercoil in C.C.No.307 of 2013 and thereafter the case has been re-numbered as C.C.No. 47 of 2016. The petitioner being a lady is regularly appearing before the Court and proof affidavit in this case has been filed on 28.01.2020. The petitioner is ready to cross examine the complainant and the next date of hearing is 27.02.2020. He would also submit that right of speedy trial is the constitutional guarantee given to the accused. Hence he has filed the present petition.

3. Under such circumstances , there shall be a direction to the learned Judicial Magistrate, Fast Track No.I, Nagercoil to dispose the case pending in C.C.No.47 of 2016 within a period of four months from 27.02.2020 and report compliance to this court after completion of the proceedings.
