RESPONDENT/RESPONDENT/ RESPONDENT Petition praying that in the circumstances stated therein and in the petition filed therewith the High Court will be pleased to relax the condition dated 5.6.2012 imposed in M.P.(MD). No.1 of 2012 in Crl.A(MD). No.98 of 2012 on the file of this Honourable Court. Order : This petition coming on for orders upon perusing the petition filed in support thereof and upon hearing the arguments of M/S G.KARNAN, Advocate for the petitioner and of MR.P.KANDASAMY, Government Advocate (Crl.side) on behalf of the Respondent the court made the following order:- It is seen that this petitioner was convicted by the trial Court in S.C.No.49 of 2012 on 10.05.2012 for offences under Section 7 of the Prevention of Corruption Act and was sentenced to undergo various terms of imprisonment.

Challenging the conviction and sentence, the petitioner filed Crl.A.(MD) No.98 of 2012 and filed M.P.No.1 of 2012 for suspending the sentence of imprisonment. This Court in M.P.No.1 of 2012 suspended the sentence and granted bail to the petitioner on condition that he should report before the trial Court on the 1st working day of every English Calender month at 10.30 a.m. pending disposal of the appeal.

2. This petition has been filed by the petitioner/accused contending that he is 70 years old and that he needs to undergo a surgery in Chennai and therefore, he may not be in a position to appear before the trial Court on the 1st working day of every English Calender month and that he undertakes to appear before the trial Court from the 1st of January 2017.

3. Accepting the submission, the condition imposed by this Court in M.P.No.1 of 2012 dated 05.06.2012 is suspended till 31.12.2016. The petitioner shall comply with the condition from 01.01.2017.
