ORDER

This petition has been filed by the petitioner to quash the FIR in Crime No.327 of 2022 for the offences under Sections 294(b), 324 and 506(2) of IPC and Section 4 of Tamil Nadu Prohibition of Harassment of Women Act, 2002 as against the petitioner.

According to the petitioner, based on the complaint lodged by the second respondent, the case in Crime No.327 of 2022 for the offences under Sections 294(b), 324 and 506(2) of IPC and Section 4 of Tamil Nadu Prohibition of Harassment of Women Act, 2002 has been registered and now, the case is pending for investigation. There are no materials available as against the petitioner to proceed with the case and only to reckon vengence over the previous enmity between the parties, this petition has been filed. There are no privillage to constitute offences under Sections 294(b), 324 and 506(2) of IPC and Section 4 of Tamil Nadu 2/5

Prohibition of Harassment of Women Act, 2002. Therefore, he filed this petition.

3. The learned Counsel for State of TN(Crl.Side) would submit that already they conducted investigation and final report is ready. Since this Court has granted interim order, they are unable to file final report. But, the final report is ready in the year 2025 itself.

4. This Court has perused the records. On perusal of the records, there are some serious allegations to constitute offences and the first respondent also, after investigation, filed final report. This Court has also perused the same. As per the same, there are some allegations to constitute offences. Therefore, at this stage, FIR cannot be quashed. However, the petitioner is at liberty to challenge the final report, if any filed by the respondent.

5. With the above observations, this Criminal Original Petition is dismissed.
