ORDER

This criminal Original Petition has been filed under Section 407 Cr.P.C., praying to transfer the case to V Metropolitan Magistrate Court, Chennai in whose jurisdiction the cheque was dishonoured.

2. Heard the learned Counsel for the petitioner.

3. The learned Counsel for the petitioner brings to the notice of this Court that the petitioner has moved a petition seeking transfer of case in C.C.No.12 of 2012 pending on the file of the Judicial Magistrate, Aranthangi filed under Section 138 of the Negotiable Instruments Act, in keeping with the decision of the Honourable Apex Court in Dashrath Rupsingh Rathod Vs. State of Maharashtra and another reported in (2014)9 Supreme Court Cases 129.

4. In view of the above, this Criminal Original Petition stands disposed of with a direction to the trial Court to dispose of the petition seeking transfer as expeditiously as possible in keeping with the judgment of the Honourable Apex Court referred to above. Consequently, the connected Miscellaneous Petition is closed.
