ORDER : The Court Made the following order :- The petitioner/sole accused was arrested and remanded to judicial custody on 30.11.2015 for the alleged offences punishable under Sections 7 and 13(2) r/w 13(1)(d) of Prevention of Corruption Act, 1989, in Crime No.11 of 2015 on the file of the respondent police and hence, seeks bail.

2.The case of the prosecution is that the petitioner demanded Rs.5,000/- from the defacto complainant for issuing sales tax assessment order. A trap was laid by the respondent with the official witnesses and the petitioner was got red-handed when she received a sum of Rs.4500/- from the defacto complainant and the case has been registered for the aforesaid offences. 3.The case of the petitioner is that the petitioner is an innocent person and only to harass the petitioner, a false case has been foisted against the petitioner and she worked for more than 20 years without any blemish.

4.The learned Government Advocate(Crl.side) submitted that the petitioner received a sum of Rs.4500/- for issuing sales tax assessment order and at that time, she was red-handed.

5. The learned counsel for the petitioner submitted that already the petitioner is under suspension and he prays for grant of bail to the petitioner.

6.Considering the fact that the charge against the petitioner is that she demanded and received bribe of Rs.4500/- and the witnesses and the defacto complainant are official witnesses, this Court is inclined to grant bail to the petitioner with certain conditions. Accordingly, the petitioner is ordered to be released on bail on her executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the learned Chief Judicial Magistrate,Special Court, Thoothukudi, and on further condition that the petitioner shall appear before the respondent police daily at 10.00 a.m for a period of two weeks and thereafter, as and when required for interrogation. sd/- 08/12/2015 / TRUE COPY / Sub-Assistant Registrar (C.S.)
