PETITIONER/PETITIONER/PETITIONER PETITIONER/ACCUSED NO.3 Vs THE STATE REP.BY, THE INSPECTOR OF POLICE D1- SELLUR POLICE STATION, MADURAI CITY.

CR NO. 2871/2016. ... RESPONDENT/RESPONDENT/RESPONDENT RESPONDENT/COMPLAINANT Petition praying that in the circumstances stated therein and in the petition filed therewith the High Court will be pleased to extend the period of time for surrender as well as to comply the condition mentioned in the order passed by this Honourable Court in Crl. M. P (MD) No. 4877/2017 dated in Crl. O. P (MD) No. 24163/2016 and pass such further or other orders as this Honourable Court may deem fit and proper in the circumstances of the case. Order : This petition coming on for orders upon perusing the petition filed in support thereof and upon hearing the arguments of M/S.R.ARAVINDAN, Advocate for the petitioner and of MR.A.RAMAR, Additional Public Prosecutor on behalf of the Respondent the court made the following order:- This petition has been filed praying to extend the period of time for surrender as well as to comply the condition mentioned in the order passed by this Court in Crl.M.P.No.4877 of 2017, dated in Crl.O.P(MD)No.24163 of 2016.

2. I have heard the learned counsel appearing for the petitioner.

3. On perusal of the records would show that anticipatory bail was granted by this Court to the petitioner, as per order, dated 10.01.2017 in Crl.O.P(MD)No.24163 of 2016 stating that on his appearance within a period of 15 days from the date on which the copy of the order is made ready, he shall execute a bond for Rs.10,000/- with two sureties each for a like sum to the satisfaction of the respondent Police or the Police Officer, who intends to arrest or to the satisfaction of the learned Magistrate https://hcservices.ecourts.gov.in/hcservices/

concerned. The petitioner failed to produce the sureties within the stipulated time and therefore, he filed a petition in Crl.M.P.No.2412 of 2017 in Crl.O.P(MD)No.24163 of 2016, for extension of time and accordingly, 10 days time was granted from the date on which the order copy is made ready, to surrender before the Court concerned, as per order of this Court, dated 21.03.2017.

4. Again the petitioner failed to surrender within the stipulated time and filed a petition in Crl.MP(MD)No.4877 of 2017 in Crl.O.P(MD)No.24163 of 2016, for extension of time and 10 days time was granted again on payment of cost of Rs.500/- to the Legal Aid Services Authority, attached to this Bench. Again the petitioner failed to appear within the time granted by this Court. Hence, the present petition is filed seeking extension of time on medical grounds.

5. Considering the reasons assigned, this Court is inclined to extend the time for one week, as a last chance, from the date on which the order copy is made ready, to surrender before the concerned Court. It is made clear that no further extension will be given.
