Prayer in WP(MD). 10407/ 2020 :

Writ Petition is filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus to direct the 2nd respondent to consider the petitioners representations dt 20.2.2020 and 14.8.2020 for regularization of service of the petitioner on completion of 10 years of service in the post of part time Sweeper on 11.12.2019 and allow time scale of pay, in the light of the proceedings in Ma.A.no.533/2014-- Na.Ka.no.Pi1/50862/2012 dated 25.2.2014 of the 2nd respondent. Recording the submission of the learned counsel for the petitioner that the petitioner's representations, dated 20.02.2020 and 14.08.2020, has been considered and rejected by the respondent through his proceedings, dated 07.11.2020, the contempt stands closed, since the disobedience alleged is not wilful. However, if at all the petitioner is aggrieved against the order, dated 07.11.2020, it is always open to him to challenge the same in accordance with law.
