Respondents PRAYER: Writ Petition filed under Article 226 of the Constitution of India for issuance of Writ of Mandamus directing the respondent to include the name of the petitioner in the provisional list for the post of Grade II Police Constable (Men, Women & Transgender), Grade II Jail Warder (Men & Women) and Firemen for the year 2019, under ex-servicemen quota.

This Writ Petition is filed to direct the respondent to include the name of the petitioner in the provisional list for the post of Grade II Police Constable (Men, Women & Transgender), Grade II Jail Warder (Men & Women) and Firemen for the year 2019, under ex-servicemen quota.
2. Mr.K.Chellapandian, Additional Advocate General, assisted by Mr.K.Mu.Muthu, Additional Government Pleader takes notice for the respondents. By consent of both parties, this Writ Petition is taken up for final hearing at the stage of admission itself.

The grievance of the petitioner is that the petitioner participated in the written examination for the post of Grade II Police Constable and Fireman conducted by Tamil Nadu Uniform Service Recruitment Board, under the Ex-servicemen quota. According to him, though he secured 47 marks, he was not selected. Whereas, one candidate namely P.Siva, who secured 45% in Sports Quota was selected in the provisional list. It is the specific contention of the learned Additional Government Pleader for the respondents that P.Siva has been selected in the Sports Quota in a separate Roster for 10% sports quota vacancy by complying with 200 point roster system and not under Exservicemen quota. As far as the petitioner is concerned, he is belonging to BC Ex-servicemen, PSTM category, securing 47 marks, while the last selected candidate belonging to BC, Ex-servicemen quota has secured 50 marks and hence the petitioner was disqualified.
5. It is an admitted fact that the petitioner has applied under the BC Ex-servicemen PSTM category and secured 47 marks. Whereas, the last selected candidate under the above quota secured 50 marks and therefore the claim of the petitioner fails. He cannot compare himself with the person who was selected in the sports quota and therefore the Writ Petition fails.
6. In view of the above, the Writ Petition is dismissed. No costs. Consequently, connected Miscellaneous Petition is closed.
