ORDER : The Court made the following order:- The petitioner, who is arrayed as A2 apprehending arrest at the hands of the respondent police for the offences punishable under sections 294(b), 341, 342, 365, 324 and 506(i)IPC, in Crime No.569 of 2021 on the file of the respondent police, seeks anticipatory bail.
2.The case of the prosecution is that due to business motive, on 17.12.2021 at about 6.00 pm, when the de-facto complainant was visiting a site for his real estate business with his friend Kumar, the accused persons said to have wrongfully restrained and kidnapped the de-facto complainant and took him to a quarry at Maraneri Village, where they assaulted and threatened the de-facto complainant.
3.Heard both sides.
4.The earlier anticipatory bail application that was filed by this petitioner along with the other co-accused persons came to he dismissed, in so far as this petitioner is concerned noting that he is involved in the offence of 302 IPC. Crl.OP(MD)No.3514 of 2022 some other cases also. Now this is the second anticipatory bail petition filed on the ground that actually this petitioner is the victim along with the other party and he has also been cheated along with other persons. Only for the purpose of wreck vengeance or from escaping from the above said offence of cheating, a false case has been given. Except that, no other new ground has been made. 5.Considering the above fact that the petitioner is involved in a murder case, taking into note of the antecedent of the petitioner only, the earlier bail application came to be dismissed and there is no change of circumstances. So such a person is not entitled for the discretionary relief of anticipatory bail.
