ORDER
This is a petition seeking initiation of contempt proceedings against the Respondent for violation of the order, dated 28.08.2023 passed by the writ Court in W.P.(MD).No.20881 of 2023.
2. Heard Mr.S.Arunachalam, learned counsel appearing for the Petitioner and Mr.S.C.Herold Singh, learned Standing Counsel, accepts notice on behalf of the Respondent. Therefore, no further notice is required to be issued to the Respondent.

The Hon'ble Writ Court, vide judgment and order dated 28.08.2023, had allowed the aforesaid writ petition with the following directions:-- "4.This Court in W.P.(MD).No.4866 of 2023 (C.Murugan Vs. the Tamil Nadu State Transport Corporation (Tirunelvlei) Ltd., and Another) by order dated 07.03.2023 had decided this issue.
5.Accordingly, by following the order stated supra, this writ petition is allowed with the following direction: 2/6
The respondent shall pay interest to the petitioner at the rate of 6% per annum on the belated payment of the retirement benefits commencing from the date of retirement, till date of actual disbursement, within a period of three months from the date of receipt of a copy of this order, 6.No costs. "
4.The learned counsel for the petitioner submits that despite the judgment and order passed by this Court in W.P.(MD)No.20881 of 2023, dated 28.08.2023, the respondent has not complied with the direction of this Court. Thus, being no other alternative, the present Contempt Petition has been filed with the prayer that the respondent/contemnor has wilfully and deliberately flouted the order passed by this Court and is in contempt of the judgment and order of this Court dated 28.08.2023. Thus, he should be summoned and punished by exercising the powers under Sections 11 and 12 of the Contempt of Courts Act, 1971.
5. Today, when the matter is taken up, Mr.S.C.Herold Singh, learned Standing Counsel, who accepted notice on behalf of the respondent, assures this Court that the judgment and order dated 28.08.2023 passed by 3/6
the Writ Court in W.P.(MD)No.20881 of 2023 will be fully complied with. He further prays this Court to grant 2 days' time to ensure compliance with the judgment and order passed by the writ Court dated 28.08.2023 in W.P.(MD) No.20881 of 2023.

Mr.S.Arunachalam, learned counsel for the Petitioner submits that as assured by the learned Standing Counsel that the interest on the belated payment of the retirement benefits, commencing from the date of retirement, will be granted to the Petitioner within a period of two days from today, he has no objection to the Respondent being discharged from the contempt proceedings at this stage and the present Contempt Petition may be disposed of accordingly.
7. After considering the submissions made by the learned counsel for the parties and upon perusal of the judgment and order passed by the Writ Court on 28.08.2023 in W.P. (MD) No. 20881 of 2023 and in view of the assurance given by the learned Standing Counsel for the Respondent with regard to payment of interest on the belated disbursement of the retirement benefits, commencing from the date of retirement, which is to be credited 4/6
to the Petitioner's account, within a period of two days from today, this Court is satisfied that the Respondent will comply with the judgment and order of the Writ Court dated 28.08.2023 passed in W.P. (MD) No. 20881 of 2023. Accordingly, this Court deems it appropriate to dispose the present petition, as no useful purpose would be served by keeping it pending. The Respondent is therefore discharged from the contempt proceedings at this stage.
8. In view of the above, the present Contempt Petition is disposed of at this stage with a direction to the Respondent to disburse the interest on the belated payment of the retirement benefits commencing from the date of retirement, to the Petitioner within a period of two days from today, without fail. The file shall be consigned to the record. There shall be no order as to costs.
