PRAYER : Petition filed under Article 226 of the Constitution of India praying for issuance of Writ of declaration declaring the Village Assistant Recruitment pertaining to the year 2022 vide Notification No.Na.A2 6348/2022, dated 10.10.2022 issued by the fourth respondent herein as illegal and unconstitutional insofar as the recruitment pertaining to Sokkanathapatty Village, Pudukottai Taluk and District. O R D E R

This Writ Petition has been filed for a declaration of the Village Assistant Recruitment pertaining to the year 2022, vide Notification No.Na.A2 6348/2022, dated 10.10.2022 issued by the fourth respondent herein as illegal and unconstitutional insofar as the recruitment pertaining to Sokkanathapatty Village, Pudukottai Taluk and District.

2. Since no adverse order is going to be passed, notice to the fifth respondent is dispensed with.

3. The case of the petitioner is that the petitioner has applied to the post of Village Assistant pursuant to the notification issued by the fourth respondent, dated 10.10.2022. But, without conducting any interview and without passing any order, the official respondents selected the fifth respondent as Village Assistant at Sokkanathapatty Village. Hence, the present Writ Petition.

The learned counsel appearing for the petitioner would submit that the official respondents without announcing the result of the petitioner as well as other participants, secretly selected the fifth respondent as Village Assistant, which is not sustainable one. Hence, this Court may issue a direction to the official respondents to publish the result of the petitioner and furnish the appointment order of the fifth respondent to the petitioner to enable him to work out the remedy in the manner known to law.

5. The learned Additional Government Pleader appearing for the official respondents would concede that the result of the petitioner will be

published and appointment order of the fifth respondent will be furnished to the petitioner to work out the remedy in the manner known to law.

6. Considering the limited request made by the learned counsel for the petitioner, this Court, without going into the merits of the matter, directs the official respondents to publish the result of the recruitment notification dated 10.10.2022 and furnish the appointment order of the fifth respondent to the petitioner within a period of two weeks from the date of receipt of a copy of this order to enable the petitioner to work out the remedy in the manner known to law.

7. With the above direction, this Writ Petition is disposed of. No costs. Consequently, connected Miscellaneous Petition is closed. 13.02.2023 NCC: Yes / No Index : Yes / No Speaking Order : Yes / No vji
