BEFORE THE MADURAI BENCH OF MADRAS HIGH COURT DATED : 06.02.2018 CORAM :

THE HONOURABLE MR.JUSTICE G.R.SWAMINATHAN W.P(MD)No.129 of 2018 Palpandi ... Petitioner Vs.

The General Manager, Tamilnadu State Transport Corporation (Madurai) Madurai Division, Bye pass Road, Madurai.

... Respondents Prayer: This Writ Petition is filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus, directing the respondent to pay the petitioner a sum of Rs.1675/- recovered from his April 2017 salary forthwith.

For Petitioner : Mr.S.Pon Senthilkumaran For Respondent : Mr.A.Jeyaram

O R D E R

The petitioner is employed under the respondent Corporation. A sum of Rs.1,675/- was recovered from the petitioner's salary for the month of April 2018. The only ground taken by the learned counsel for the petitioner is that without passing a formal order of recovery, the said sum had been deducted from his salary. 2.It is needless to mention that without issuing show cause notice to the petitioner and without passing a formal order, no sum could have been recovered from his salary. The said recovery or deduction is clearly illegal. The respondent is directed to pay the petitioner the said sum of Rs.1,675/- forthwith. 3.This writ petition allowed accordingly. No costs.
