Respondents PRAYER: Writ Petition filed under Article 226 of the Constitution of India for issuance of Writ of Mandamus, to direct the Respondents 1 and 2 to disconnect the electricity service connection bearing No. 113-001-2619 granted in favour of the 7th Respondent in respect of the Petitioner's property situated in Survey No.348/1D1B, Neendakarai 'A' Village, Kanyakumari District, and further to initiate appropriate action in accordance with law as against the Respondents 5 and 6 for their failure to conduct proper field inspection and for illegally granting the electricity service connection without verifying the title, revenue records and lawful possession of the property by considering the petitioner's representations, dated 22.01.2025, 12.12.2025 and 30.12.2025 within a time frame to be stipulated by this Court.

O R D E R

The petitioner has approached this Court seeking a direction to respondents 1 and 2 to disconnect Electricity Service Connection No. 113-001-2619 granted in favour of the 7th respondent.

2. According to the petitioner, the subject property in which the electricity service connection has been installed belongs to him. It is contended that the 7th respondent has no right over the said property. The 7th respondent has filed a suit for declaration and injunction, which is pending. During the pendency of the said suit, respondents 1 and 2 have allegedly provided the electricity service connection to the 7th respondent arbitrarily.

3. Mr. S. Vashik Ali, learned counsel appearing for the 7th respondent, placed on record the order passed by the coordinate Bench of this Court 3/6

in W.P.(MD) No.3356 of 2025 dated 11.02.2026. The said writ petition was filed by the 7th respondent challenging the order of the second respondent temporarily disconnecting the domestic electricity service connection on the ground that the 7th respondent had not submitted the required documents. By order dated 11.02.2026, this Court directed respondents 1 and 2 therein to inspect the property and, if they found any thatched shed and upon verification of the patta standing in the name of the writ petitioner, to provide electricity service connection to him.

4. The above order makes it clear that the temporary electricity service connection granted in favour of the 7th respondent had already been disconnected.

5. In view of the above position, the relief sought in the present writ petition does not survive for consideration. Accordingly, the writ petition is dismissed reserving liberty to the petitioner as well as the 7th respondent to agitate their respective rights before the jurisdictional civil court in the pending suit. It is made clear that any action by respondents 1 and 2 to provide electricity service connection to the 7th respondent in 4/6

respect of the subject property shall be taken only after issuing notice to the petitioner. No costs. Consequently, the connected miscellaneous petition is closed.
