ORDER

This is a petition seeking initiation of contempt proceedings against the Respondents for violation of the order, dated 02.09.2022 passed by this Court in W.P.(MD)No.11552 of 2022.

2. Heard Ms.A.Amala, learned counsel for the Petitioner and Mr.F.Deepak, learned Special Government Pleader for the Respondents.

3. When the matter was taken up on 28.02.2025, this Court passed the following order:

"M/s.A.Santhiya Jothi, learned Counsel for the petitioner prays for an adjournment on some personal grounds to argue the case.

2.Mr.F.Deepak, learned Special Government Pleader for the respondents/contemnors has no objection to the aforesaid prayer made by the learned Counsel for the petitioner.

3.Accordingly, as prayed for by the learned Counsel for the petitioner, adjournment is allowed. In the meantime, the learned counsel for the petitioner is directed to furnish a copy of the order made in W.A. (MD) No.1721 of 2023. 4.Put up this case 'for orders' on 04.03.2025". before the appropriate Bench.".

Pursuant to the order dated 28.02.2025, Mr.F.Deepak, the learned Special Government Pleader for the Respondents, has produced the order dated 03.03.2025, passed by the 1st Respondent, and submits that the Respondents have fully complied with the orders passed by this Court on 02.09.2022 in W.P.(MD)No.11552 of 2022. A copy of the said order has been taken on record and furnished to the learned counsel for the Petitioner.

Mr.F.Deepak, learned Special Government Pleader for the Respondents further submits that in the 3rd page of the order dated 03.03.2025, it has been stated that from 02.07.2018, all service and monetary benefits has been paid to the Petitioner. Thus, the entire amount due to the Petitioner has been paid in compliance with the orders passed by this Court dated 02.09.2022 in W.P.(MD)No.11552 of 2022. Therefore, he prays that the Respondents be discharged from the contempt proceedings.

Ms.Amala, the learned counsel for the petitioner, submits that she needs to verify whether the judgment and order passed by this Court on 02.09.2022 in W.P.(MD)No.11552 of 2022 have been fully complied with. She also states that, as per the order dated 03.03.2025, it appears that the entire amount has been paid to the petitioner. Further, she submits that if the order is not complied with by the respondents, the petitioner may approach this Court. Therefore, she states that she has no objection to discharging the respondents from the contempt proceedings at this stage.

In view of the submissions made by the learned counsel for the Petitioner and the learned Special Government Pleader for the Respondents, and upon perusal of the order dated 03.03.2025, particularly page 3, this Court is of the view that the judgment and order dated 02.09.2022 passed in W.P.(MD)No.11552 of 2022 have been complied with. The Petitioner has been paid the amount with effect from 02.07.2018, along with all service and monetary benefits. Considering the same, this Court deems it appropriate that no useful purpose would be served by keeping the contempt proceedings pending. Therefore, the Respondents are discharged from the contempt proceedings. However, it is made clear that if the Petitioner is aggrieved and it appears that the Petitioner has not been paid the entire amount as per the 4/6

direction issued by this Court, the Petitioner is at liberty to challenge the same before the competent Court.

8. In view of the above, the Contempt Petition is disposed of. The file shall be consigned to record. No costs.
