ORDER

The petitioner, who apprehends arrest at the hands of the respondent police for the offences punishable under Sections 8(c), 20(b)(ii)(c), 25 and 29(i) of NDPS Act, in Crime No.15 of 2023, on the file of the respondent police, seeks anticipatory bail. 2.The case of the prosecution is that the respondent police seized 2kg of ganja and 21.6 kg of ganja from two cars. It is a case of jumped out bail and NBW is pending against the petitioner. Hence, the apprehension of arrest. Hence, a case has been registered as against the petitioner.

3.The learned counsel appearing for the petitioner submitted that the petitioner has been falsely implicated in this case and he has not committed any offence. He seeks this Court to grant anticipatory bail to the petitioner. https://www.mhc.tn.gov.in/judis

4.The learned Additional Public Prosecutor appearing for the respondent submitted that the offences committed by the petitioner are serious in nature and the quantity of ganja is commercial quantity.

5.Considering the facts and circumstances of the case, this Court is directing the petitioner to surrender before the Principal Special Court for Trial of NDPS Act Cases, Madurai. The petitioner shall submit an application for recall of warrant before the concerned Court. On such submission, the concerned Court shall consider the application in accordance to law on merits on the same date. 6.With the above said directions, the criminal original petition is disposed of. 26-02-2026 Tmg To
