PRAYER: This Transfer Civil Miscellaneous Petition is filed under Section 24 of Civil Procedure Code, to withdraw the H.M.O.P.No.365 of 2019 from the file of the Principal Sub Court, Kancheepuram and to transfer the same to the file of the Sub Court, Tirumangalam. For Petitioner : Mr.PT.S.Narendravasan For Respondent : No appearance

O R D E R

This petition is filed seeking transfer of the petition in H.M.O.P.No.365 of 2019 now pending on the file of the Principal Sub Court, Kancheepuram to the file of the Sub Court, Tirumangalam. The said petition was filed by the respondent herein for dissolution of marriage.

2. On 24.08.2020 this Court had interacted with the parties along with their respective counsel.

3. In order dated 30.07.2020, this Court recorded that the Vakalath of the respondent has been returned. Even though his Vakalath was returned, since this Court wanted to explore the possibility of an amicable settlement between the spouses, it entertained the presence of the learned counsel for the respondent.

4. Thereafter the case came to be posted today. Today neither the respondent has logged-in nor his counsel. In fact, he does not even appear to have re-presented the papers after complying the defects.

5.Turning to merits of the case, this Court is satisfied with the reasons stated in the affidavit filed in support of this petition.

6. In fine, this Transfer Civil Miscellaneous Petition is allowed. Accordingly, H.M.O.P.No.365 of 2019 now pending on the file of the Principal Sub Court, Kancheepuram is directed to be withdrawn from the said Court and transferred to the file of the Sub Court, Tirumangalam, for disposal as per law. No costs. Consequently, the connected miscellaneous petition is closed.
