ORDER : The Court Made the following order :- The petitioner/A2, who apprehends arrest at the hands of the respondent Police for the offence punishable under Sections 294(b), 323, 324 and 506(ii) IPC in 1/3
Crime No.76 of 2023, on the file of the respondent police, seeks anticipatory bail.
2. The case of the prosecution is that on 22.12.2023, when the defacto complainant returning back to his house, at that time, wordy quarrel arose between the petitioner and the accused persons, due to which, the petitioner along with other accused persons attacked the defacto complainant by using hands and threatened him with dire consequences. Hence the case.
3. Heard the learned counsel on either side and perused the material records of the case.
4. It appears that this is the third application for anticipatory bail and the first application filed by the petitioner in Crl.O.P.(MD).No.23631 of 2023 was dismissed by this Court on 04.01.2024 on the ground that previous antecedent reported against the petitioner and the second application filed by the petitioner in Crl.O.P.(MD).No.1150 of 2024 was dismissed by this Court on 29.01.2024 on the ground that there was no change in circumstances of the case. Now, this application is filed by the petitioner without referring the change of circumstances to consider the case. 2/3
5. Considering the above facts and circumstances of the case and also considering the fact that there is no change in circumstances, since the dismissal of the earlier petitions, this Court is not inclined to grant anticipatory bail to the petitioner.
